When you agree to have an uncontested divorce, it usually means that you and your spouse do not have many disagreements on the issues that present themselves during the separation process. These issues include how you plan to raise your child and the visitation rights for each parent. Still, Georgia law requires a legal court pleading for underaged children in order to observe Georgia Child Support Guidelines. 

When parents use an uncontested parenting plan, they sort out unanimously if one or both parents should have legal custody, who would be the primary caregiver, and the visitation schedules or parenting rights. Georgia’s Contested Parenting Plan

A contested parenting plan aids individuals who cannot agree on the vital details that involve their child. With this parenting plan, each parent will work with their custody attorney to propose their own custody plan regarding schooling, visitation, medical concerns, etc which will initiate the initial negotiation process.  Should the parties be unable to come to an agreement, a judge will then consider both proposals and choose the plan that seems right for the child or try to incorporate both proposals into one legal plan.

Physical and Legal Custody

When a Canton court grants a parent physical custody, that parent becomes the child’s caregiver and is solely responsible for the child’s well-being when that the child is living with them. For instance, the caregiving parent has to ensure that their child gets to school on time every day, has all the equipment necessary for their daily activities, and has safe and clean living quarters.

  •  When a parent has sole physical custody, it usually means that the other parent can negatively impact the child. In response, they should not receive much or any time at all with the child. A judge can deny a parent custody if they find that the parent to be abusive or without the capabilities of taking care of the child alone. 

Along with the decision of physical custody comes the question of who should receive legal custody. Legal custody refers to who is allowed to make decisions involving the child. Parents can choose either joint legal custody or sole legal custody. 

  • Joint legal custody keeps both parents in the loop when it comes to the big decisions in their child’s life. While one parent may be allowed to make some of these decisions alone without consulting with the other, most decisions need to be unanimous. When parents cannot agree on a decision, a parenting coordinator can alleviate the issue by weighing both proposed plans and choosing the one that seems fit for the child. 
  •  Sole legal custody means that one parent can make all the major decisions in their child’s life. While the other parent cannot interfere with how the caregiving parent raises the child, they can still have frequent visitation rights.
